Using a six point scale, a one (1) indicates serious problems or problems; a six (6) indicates no problem or outstanding performance. A three (3) or less indicates need for attention in this area. Four (4) or more indicates satisfactory performance.

• Statement advances your case theory.

• Statement contains sufficient context facts and all legally significant facts. Immaterial facts are omitted.

• Facts are accurately stated. No facts are misrepresented.

• Undisputed facts are distinguished from disputed facts.

• Favorable facts are emphasized.

• Unfavorable facts are neutralized.

• Statement is organized according to the method that most persuasively tells the story.

• Statement tells an engaging, interesting story that humanizes your client.

• Inferences are created in the reader's mind that point towards favorable conclusions about your client's case.
